Defanti Online Shop Regulations in force from 1st September 2015

  1. General Information:

These Regulations specify the terms and conditions, scope and principles of the services provided by the Online Store BONAM conducted by the company PANAMERICA Jolanta Włodarczyk 80-884 Gdańsk, Igielnicka 5/1, NIP 583 101 75 14, Regon 190881527

  1. Seller provides through Online Store retail sales - not wholesale.
  2. Definitions used in Terms and Conditions:
  • Online Store - an online store operating at http://www.bonam.pl run by the Seller
  • Product - a product presented by the Seller through the website of an online store that could be the subject of a Contract of sale
  • Seller - Online Store entity running Online Store BONAM, making the sale of goods on the site called further in the Terms and Conditions: Shop
  • Client - user who places an order for the purchase of selected products
  • Consumer - Client who is a natural person who takes legal action with the entrepreneur not directly related to its business or professional activity
  • Working days - all days of the week from Monday to Friday, excluding days of public holidays,
  • Delivery - physical act of delivering to the Customer by the Seller via deliverer, item specified in the contract
  • Deliverer - an entity with which Seller cooperates on the field of delivering Products specified in the Contract:

- courier

- Polish Post S.A.

  • Contract - the Customer's declaration of intent submitted via the Online Store specifying: the type and quantity of goods contained in the assortment online store at the time of the order, method of payment, method of delivery of the goods, place of delivery of the goods and the Customer's data forming by the Customer submission of an offer to conclude a contract of sale through the Online Store
  • Client Account - individual for each client panel running on his behalf by the Seller, after the Customer registration and conclusion of an agreement to provide services running client accounts
  • Registration - physical act done in the manner specified in the regulations required for use by the Client of all the functionality of an online store
  • Cart - part of an online store through which the customer makes the order
  • Sales agreement - a contract of sale concluded on the distance between the Customer and Seller, as a result of an order and its confirmation by the Seller using electronic means of communication
  • Durable carrier - means a material or tool for Customer or Seller allowing to store information addressed personally to him in a way that allows access to information in the future for a time appropriate for the purposes of the information used and which you can play back the stored information unchanged.

 

III Using the Online store

  1. To ensure the security of communications and data provided in the Online Store (in particular the prevention of acquisition and modification by unauthorized persons of personal data sent over the Internet) Seller provides the security of data transmitted online store by using SSL protocol.
  2. To place an order in the Online Store and use the services available on the website of an Online Store, you must have an active e-mail account.
  3. It is forbidden to provide by the Customer illegal content and use by the Client Store, Store Web Site or free services provided by the Seller in a manner contrary to the law, morality, violating the personal rights of third parties.
  4. The Seller declares that the use of services supplied electronically due to its public nature can be associated with a risk of acquiring and modifying customer data by unauthorized persons, so customers should use appropriate technical solutions which as much as possible dismiss stated above threats. In particular, it is recommended to use antivirus and identity protection software. Seller never asks the client to reveal in any form password.

  6. In the event of errors or omissions on the website of an online store, in particular with regard to the price and availability, the Seller reserves the right to inform the customer and allow him to change the order.

 

IV Registration, placing orders

  1. In order to make purchases in the Online Store registration is not required.
  2. The customer can also create Client Account facilitating multiple purchases in the Online Store. Registration is required to create Client Account. Client Account is free of provisions and is of unlimited duration.
  3. Registration of Client Account in Online Store takes place by completing a registration form indicating your e-mail address, password and personal data required for shipping the products or issue a VAT invoice. The condition for registration is to read and accept these regulations, as well as agree to the processing of personal data by BONAM necessary for the realization of the orders placed in Online Store, as well as to entrust the processing of the data to entity.
  4. The customer is obliged to properly and completely fill the registration form located on the website of an Online Store and update the data contained in the registration form in case of any changes in the data contained in the registration form.
  5. After completing the registration form, press "Register". Then, on the provided in the registration form e-mail address will be sent a message confirming the registration of Client Account. The contract for services of providing possibility of creating and using Client Account on internet site of Online Store is concluded at the time of receiving by the customer e-mail confirming the registration of Client Account.
  6. After registration, the Customer is required to use predetermined on the website of an Online Store login and password, which is confidential. The consequences of the disclosure login and password by the Client to a third parties are borne solely by the Client.
  7. The customer has the right to terminate at any time the contract on Client Account by submitting a statement of termination of the contract. The exception is a situation in which an order placed by the Customer is in progress. In this case, the effect of terminating the contract will be postponed to the moment of realization of the contract.
  8. The offer in the shop does not constitute an offer within the meaning of the Civil Code, but only an invitation to tender a contract of sale
  9. The customer can place orders in the Online Shop 24 hours a day every day of the calendar year through the website http://www.bonam.pl.
  10. The customer is obliged to provide in order, real data that allow its realization.
  11. A necessary element in the ordering procedure is to read and accept by the Client Terms and Conditions, what every customer confirms by checking the appropriate box before finalizing order. Lack of acceptance by Client of Terms and Conditions during the ordering procedure forecloses the possibility of acquisition of goods through the Online Store.
  12. Information about the total Contract value includes the price of the goods and the cost of its delivery. This information is always given during the order process, including just before and at the time of the Acceptance and submission by the Customer of an order. These are total costs that customer is obliged to pay with the applicable taxes and the costs of delivery.
  13. Placing an order is followed by choosing the products, selecting the method of delivery, method of payment and filing the order form. Each time before finishing the shopping in cart, customer is informed about the total price for the selected products and delivery costs.
  14. By placing an order the Customer makes an offer of sale agreement of goods covered by the contract.
  15. After placing an order Seller sends to the specified by the customer address specification of the placed order. Then, after confirming an order Seller sends to the provided address information about confirmation of the placed order. At the moment of the receiving the information about confirmation of the placed order agreement is concluded. Seller confirms the terms of sale by sending them on a durable medium to the email address or address indicated by the Client during registration or ordering.
  16. The effective placing orders requires a computer with Internet access and a web browser at least Internet Explorer 7.0 or higher, Google Chrome, FireFox, Opera, Safari, email account running on any server and cookies enabled in your browser. Some features of the Online Store BONAM may depend on the software installed, eg. The type of Java, Java Script, etc.
  17. The seller may refuse to accept the offer, informing the customer about the reason of the refusal.

 

V Product Prices

  1. Information about the price of the goods (with description of their characteristics) are presented in the Online Store and placed beside presented Products, are given in Polish zloty and are binding at a time of placing the order by the Customer.
  2. The prices at the Online Store placed beside offered products on the Website:
  3. a) contain all duties, fees and taxes, including VAT and are stated in Polish zloty;
  4. b) do not contain information about shipping costs; Delivery costs depend on the method of delivery to the Customer, the value and size of the order and are provided at the time choosing the method of delivery of the product by the Customer.
  1. The cost of delivery of ordered goods will be specified at the online shop during the order process, including just before and at the time of the approval and submission the order by the Client and are included in the total Contract value. The total value of the Contract includes the price of the goods and the cost of its delivery.
  1. The Seller reserves the right to change prices of goods in an offer and withdraw promotions. The aforementioned changes do not affect the price of goods for which order has been placed before entering these changes into force.
  1. Offers valid in the store are not subject to additional discounts.

 

VI Payments

  1. The customer can choose the following methods of payment:

- Bank transfer to the Seller's bank account, realization of order begins when the customer receives the confirmation of the order, and dispatch will be made immediately after receiving the payment on Sellers bank account

- A bank transfer via the internal payment system, operated by company Przelewy24,registered in Poznań, in this case realization of the order will be initiated after sending to the Client confirmation of the order and after receiving by the seller information from system Przelewy24 about realization of payment by the Client.

- Payment by card, card payments operator is PayPro SA Agent Rozliczeniowy, ul. Kanclerska 15, 60-327 Poznań, registered in Rejestr Przedsiębiorców Krajowego Rejestru Sądowego run by Sąd Rejonowy Poznań Nowe Miasto i Wilda in Poznań, VIII Wydział Gospodarczy Krajowego Rejestru Sądowego under number KRS 0000347935, NIP 7792369887, Regon 301345068.

- Cash on delivery - customer pays value of the contract plus the delivery costs to the deliverer at the time of delivery of Products and dispatch will be made after sending to the Client confirmation of the order

- Cash at pickup - a payment for the Seller at the time of pickup of Products, the contract will be made immediately after sending to the Client confirmation of the order, and the Products will be issued to the Customer by the Seller

  1. Client who chose when ordering payment via bank transfer, should make a payment in an amount equal to the value of the contract and the costs of delivery within 72 hours of receiving an e-mail with confirmation of the order.
  2. In the event that within 5 working days from the date of sending by the Seller e-mail with confirmation of the order the customer does not pay, the contract may be canceled by the Seller (does not apply to contracts in which selected payment on delivery).

 

VII Realization of orders, methods and costs of delivery

  1. The seller realizes deliveries on the Polish territory.
  2. In the case of the delivery of the Products beyond the borders of Poland, Client should check on the Website of Online Store in "delivery" section to which zone destination country belongs. Then the proper zone should be chosen in delivery options when filling the order. Delivery costs will be calculated on the basis of the weight of the package and zone to which package will be sent.
  3. In the case of the Client's choice of delivery zone not suitable for the country to which delivery is to be realized Seller reserves the right not to realize the order. As far as possible Seller will try to contact the buyer in order to change the order.
  4. International shipments may also be subject to additional import duties, taxes or customs fees due upon arrival. These charges are not included in the item price or shipping charges and are the responsibility of the buyer. If your country doesn't show in the list in "delivery" section, please ask for availability and cost of shipment.
  5. The dispatch time is up to 5 working days from the date of confirmation of the order. In the case payment via bank transfer delivery time is counted from the date of receiving of payment on account of the Seller.
  6. Orders with the option of delivery are carried by the deliverer at the address given by the customer in the order form.
  7. On the day of dispatch (does not apply to purchases with pickup) Seller sends to the customer via e-mail confirmation of dispatch. If possible information about the posting of a parcel contains a number that allows tracking of the package.
  8. The customer has the possibility to make changes in his order until the dispatch of goods (does not apply to purchases with pickup), writing to:

  1. The customer has the possibility to pickup personally products ordered after earlier contacting the Seller and establishing a mutually convenient time and place of delivery of goods.
  2. Seller attach to every purchase receipt or VAT invoice charged on margin only on special request covering ordered goods.
  3. In the case of incomplete address data (for example an incomplete Client's address or its absence) preclusive the realization of the Contract Seller reserves the right to not realize this order.
  4. In the case of not collecting the package by the Client before deadline stated in the notification issued by deliverer. Reissue of the package will be possible only after the settlement in advance the cost of the return of the package to the Seller and the costs of resending the package to the customer (if the customer decides to re-dispatch of the contract).

 

Complaints

  1. In the case of defects or nonconformity of purchased Products with the sales contract and descriptions, customer should direct the complaint in writing by email or directly to address of the Seller, while delivering the complaint Products to the Seller.
  2. In the case of a complaint, Customer should provide defective Products together with the documents issued for the purchase of goods.
  3. The Seller will consider complaints in the shortest possible time, however, reserving the not exceedable period of 14 days.
  4. The answer to the complaint is sent in writing by e-mail or letter depending on the form of submitted complaint.

 

The right to withdraw the contract

  1. The customer is entitled to withdraw from the purchase agreement within 14 days from receiving Products without giving any reason. The term 14 days to cancel the contract of sale is calculated from the date on which the customer took possession of the purchased Products. In order to withdraw from the purchase contract customer can use located on the Store website withdrawal form at "form" while it is not mandatory.
  2. In case of withdrawal from the sales contract, the Seller returns the Customer the cost of purchasing goods with the cost of delivery to the Customer. Exceptions are costs resulting from selection of Customer of the method of delivery of the Products other than regular cheapest way to deliver the Products offered by the Seller. Sellers realizes refund as soon as possible but not later than 14 days from the effective delivery by the Client declaration of withdrawal from the sales. Reimbursement payments is realized by the same form of payment as Client chosen when making payment. The use of another method reimbursement payment is possible after individual agreement with the Client and Seller.
  3. In the event of exercising the right of withdrawal, the Client shall only bear the cost of returning the Products. Client should make return as soon as possible, but no later than within 14 days from the date on which the Client has informed the Seller about withdrawal. The exception is a situation in which the Seller has agreed with the Client personal pickup of the Products. Returned Products should be unchanged.
  4. The right of withdrawal from a distance purchased agreement is not entitled to the Client in particular with regard to contracts:

- for the provision of services if the Seller made a full service with the explicit agreement of the consumer, who has been informed before the beginning of the service that after fulfilling order by entrepreneur client loses the right of withdrawal

- In which the object is to provide for non-prefabricated, manufactured according to the specifications of the consumer or the made to meet his individual needs

- In which the object is to provide for Product with rapid decay or having a short term for consumption

- In which the subject of the provision is the thing delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygiene reasons, if it were unsealed after delivery

- In which the subject of agreement are things that after delivery, due to their nature, are inextricably linked to other things.

- In which the subject of the agreement are alcoholic beverages, the price of which has been agreed upon conclusion of the contract, and the supply of which can only take place after 30 days and whose value depends on fluctuations in the market, the trader has no control

- Concluded by public auction

  1. In the event of withdrawal of the sales contract, the Seller asks kindly ask if Client can send back the Product in its original packaging.
  2. If Client filed a statement of withdrawal from the agreement before the Seller confirmed the order, the offer presented by the Customer cease to be binding.

 

Copyrights and protection of personal data

  1. Content posted on the Website of the Online Store is protected by copyright and may not be amended and supplemented. Site Content may not be duplicated, distributed or published in violation of the law on copyright and related rights.
  2. Trademarks and logos published on the Store are registered trademarks belonging to the owner and are used for informational purposes only. They cannot be used without the consent of the owner.
  3. The administrator of your personal information voluntarily provided to the Seller within one time order placement and by providing service of Client Account is the Seller.
  4. The personal data provided by the customer are processed by the store www.bonam.pl headquartered in Gdansk Igielnicka 5/1 Poland.
  5. Personal data are processed solely for the purpose of the contract realization.
  6. If the customer agrees, the data is also processed in order to inform about new products, services and promotions offered by the Store www.bonam.pl.
  7. Personal data is not disclosed to third parties for marketing purposes.
  8. The Client has the right to inspect his data, to request corrections or additions and their removal.
  9. When making purchases at Online Store customer expressly agrees they will to put his personal data in the database Online Store and processed solely for the purpose of the contract.
  10. Seller provides the option to remove your personal information from dataset.

 

Final Provisions

  1. Contracts concluded via the Online Store BONAM are concluded in Polish and English.
  2. Terms and conditions are available free of charge for Clients.
  3. Use of pictures and descriptions, in whole or in part without permission of the author is always a violation of copyright law - according to the Act of February 4 1994roku.
  4. The customer can use extrajudicial methods of complaint and redress. Rules for access to these procedures are available on the websites of municipal and district consumer advocates, social organizations to which statutory tasks include consumer protection, Voivodship Inspectors of the Trade Inspection.
  5. Voivodship Inspector of Trade Inspection is entitled to initiate on the Customer's request mediation proceedings on amicable settlement of the dispute between Customer and Seller.
  6. The customer can take advantage of a permanent amicable consumer courts operating at the Trade Inspection with a request to settle the dispute arising from the contract with the Seller.

  8. A free legal assistance for consumers is also provided by non-governmental organizations such as the Consumer Federation with helpline number 800 007 707 and the Association of Polish Consumers at email porady@dlakonsumentow.pl

 

These regulations come into force on 1 September 2015 and is valid for all contracts concluded from that date. Seller reserves the right to alter these regulations. All orders accepted for realization before the entry into force of new regulations are based on the Regulations applicable at the date of the order by the Customer. A possible change in the Terms and Conditions we will inform on our website www.bonam.pl 14 days in advance and by electronic message transmitted by e-mail containing a link pointing change in the Terms and Conditions. The customer is entitled to accept the changes or withdraw from the contract without any encumbrances.
